Important notice about dispute resolution
These Terms contain a binding individual-arbitration agreement and a class-action waiver (§18). By using the Site or purchasing from our shop, you agree to resolve most disputes with Cliq Mobile through individual arbitration rather than in court, and you waive the right to participate in a class action.
You may opt out of the arbitration agreement within thirty (30) days of first accepting these Terms by following the instructions in §18.6.
1. Acceptance of these Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Cliq Communications LLC, a Florida limited liability company, doing business as Cliq Mobile ("Cliq Mobile," "we," "our," or "us").
These Terms govern your access to and use of the website located at www.gocliqmobile.com and its subdomains, our online shop, any email subscriptions you sign up for, and any related services we make available (collectively, the "Site").
By accessing, browsing, or using the Site, by submitting any signup form, or by purchasing from our shop, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Site.
2. What Cliq Mobile is (and is not)
Cliq Mobile is an independent consumer resource site and a retailer of unlocked mobile phones. We (a) publish editorial comparisons, reviews, and educational content about the federal Lifeline program and the providers that participate in it, (b) sell unlocked mobile phones through our online shop, and (c) earn affiliate commissions from some of the providers we list.
Cliq Mobile is not a Lifeline service provider, an Eligible Telecommunications Carrier ("ETC"), or a wireless carrier of any kind. We do not provide telephone, wireless, broadband, or any other form of telecommunications service. To receive service under the federal Lifeline program (47 U.S.C. § 254; 47 CFR Part 54), you must qualify and enroll directly with an ETC. A purchase from our shop does not enroll you in Lifeline service, create any service obligation on our part, or confer any telecommunications-service rights on you.
Cliq Mobile is not affiliated with, endorsed by, or sponsored by the Federal Communications Commission ("FCC"), the Universal Service Administrative Company ("USAC"), any federal or state government agency, or any particular Lifeline provider. References to government programs are for informational purposes only and are not legal, tax, or government-benefits advice.
3. Eligibility
The Site is intended for residents of the United States. By using the Site or purchasing from our shop, you represent and warrant that you are at least eighteen (18) years old (or the age of majority in your state, if different). If you are under eighteen, you may use the Site only with the involvement of a parent or legal guardian.
The Site is not directed to children under thirteen, and we do not knowingly collect personal information from children under thirteen (see our Privacy Policy §11).
4. Email subscriptions
When you submit your email address through any capture form on the Site, you are requesting to receive communications from us on the topics described in the consent language shown at signup. We operate a double opt-in workflow: you will receive a confirmation email, and we will not send you marketing communications until you click the confirmation link.
By submitting a signup form and checking the accompanying consent box, you agree to receive email updates, provider comparisons, and occasional promotional offers from Cliq Mobile about Lifeline service, unlocked phones, and related benefit programs. You understand that Cliq Mobile may earn commissions from affiliate partnerships and sells phones directly.
You may unsubscribe at any time by clicking the unsubscribe link in any marketing email we send you, or by visiting the unsubscribe page. You may update your email preferences through the preferences page. Unsubscribe requests are honored promptly and in any event within the period required by the CAN-SPAM Act (15 U.S.C. § 7704(a)(4)) — ten business days.
5. Affiliate relationships
Some outbound links on the Site are affiliate links. Cliq Mobile may receive a commission when a reader clicks an affiliate link and subsequently applies for service with the linked provider. Affiliate relationships do not affect our rankings, editorial judgments, or the ordering of providers on the Site. See our Affiliate Disclosure for details and a current list of affiliate partners.
Affiliate relationships are disclosed consistent with the Federal Trade Commission's Endorsement Guides (16 CFR Part 255). Clicking an affiliate link does not impose any additional cost on you; the provider pays the commission, not you.
6. Shop — orders, shipping, and returns
Purchases from our shop are sales of goods by Cliq Mobile to you, governed by these Terms and our Shipping & Returns policy, which is incorporated by reference.
6.1 Orders
Placing an order constitutes your offer to purchase the selected product(s) at the displayed price plus any applicable shipping and taxes. We may accept or reject any order in our sole discretion, including orders that appear fraudulent, that contain pricing or availability errors, or that cannot be shipped to your address.
6.2 Pricing, taxes, and fees
Prices are stated in U.S. dollars and are subject to change without prior notice. Applicable sales taxes are calculated at checkout based on your shipping address.
6.3 Shipping and delivery
We ship to U.S. addresses only. Estimated shipping times are provided at checkout. Consistent with the FTC Mail or Telephone Order Merchandise Rule (16 CFR Part 435), if we are unable to ship your order within the applicable time (or thirty days if no time is stated), we will contact you and offer either a refund or the option to consent to a further delay.
6.4 Returns
Returns are accepted within thirty (30) days of delivery, in original condition and with all original accessories, per our Shipping & Returns policy.
6.5 Warranty
Manufacturer warranties (where applicable) are provided directly by the phone's manufacturer. Except to the extent required by law, Cliq Mobile provides no separate warranty on shop products. See §14 for disclaimers.
6.6 Payment
Payment for shop purchases is processed by our third-party payment processor (currently Stripe). Cliq Mobile does not store your full payment-card data. Your payment is governed by the terms of that processor in addition to these Terms.
6.7 Risk of loss
Risk of loss for shop products passes to you upon our delivery of the products to the carrier.
7. Editorial content disclaimer
Content on the Site is provided for general informational purposes only. It is not legal, tax, financial, insurance, medical, or government-benefits advice. You should verify eligibility rules, enrollment processes, and plan terms directly with USAC (usac.org/lifeline) and with the specific provider before applying. Program rules and plan terms can change.
Cliq Mobile does not guarantee that any reader will be approved for Lifeline, California LifeLine, or any other assistance program. Approval decisions are made solely by the relevant government authorities and participating providers.
Editorial opinions expressed on the Site are those of Cliq Mobile as a publisher. Ratings and rankings of providers reflect our editorial judgment as of the applicable "last updated" date; they are not representations about a provider's present-day service quality.
8. Intellectual property
All content on the Site — including text, graphics, logos, images, compilations, software, and the selection and arrangement thereof — is owned by Cliq Mobile or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws.
Subject to these Terms, Cliq Mobile grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not (a) reproduce, modify, or create derivative works from Site content; (b) frame or mirror the Site; (c) scrape the Site (except for legitimate search-engine indexing); (d) use any automated system (bots, crawlers, scripts) that sends requests at a rate exceeding what a human could reasonably generate using a conventional browser; or (e) use the Site in any way that infringes any third-party right.
"Cliq Mobile," the Cliq Mobile logo, and other Cliq Mobile brands are our trademarks. Trademarks of third parties (including Lifeline providers we compare or list) belong to their respective owners. Use of third-party trademarks on the Site is nominative and does not imply endorsement, partnership, or affiliation unless explicitly stated.
9. User submissions
If you submit comments, feedback, testimonials, or any other content to us (each, a "Submission"), you grant Cliq Mobile a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute the Submission in connection with the Site and Cliq Mobile's business, and you represent that (a) you own or have all necessary rights to grant that license, and (b) the Submission is accurate and does not violate any applicable law or third- party right.
Do not submit sensitive personal information (financial-account numbers, Social Security numbers, health information) in Submissions. We may reject or remove any Submission at our sole discretion.
10. Acceptable use
You agree not to:
- Use the Site in any way that violates any applicable federal, state, local, or international law or regulation;
- Impersonate or attempt to impersonate Cliq Mobile, an employee, or any third party, including submitting a signup form with another person's email address without their consent;
- Submit any form or make any purchase using fraudulent, stolen, or unauthorized information;
- Interfere with, disrupt, or place an unreasonable load on the Site or its underlying infrastructure;
- Introduce any viruses, worms, trojans, or other malicious code;
- Attempt to gain unauthorized access to any account, system, or data on the Site; or
- Use the Site to send unsolicited commercial email or to harvest email addresses or other personal information.
11. Third-party content and links
The Site contains links to third-party sites, including Lifeline provider sites. Cliq Mobile does not control those sites, does not endorse their content, and is not responsible for their availability, terms, privacy practices, or content. Your interaction with any third-party site is at your own risk and subject to that site's terms and policies.
12. Copyright complaints (DMCA)
If you believe content on the Site infringes your copyright, please send a written notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent:

Your notice must include: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and sufficient information for us to locate it; (d) your contact information; (e) a statement of good-faith belief that the challenged use is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.
13. Phone-number policy (TCPA)
Cliq Mobile does not collect, process, or maintain telephone numbers in connection with any signup or marketing flow. Accordingly, we do not place marketing or solicitation calls or text messages to any individual. The Telephone Consumer Protection Act ("TCPA"; 47 U.S.C. § 227) and implementing FCC rules (including 47 CFR § 64.1200) restrict phone-based outreach; we have structured our operations to avoid engaging in regulated phone outreach at all.
If you receive a call, text, or robocall from anyone claiming to be Cliq Mobile, it is not from us. Please report such communications to [email protected] so we can assist and investigate.
14. Disclaimer of warranties
The Site and all content, products, and services available through it are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, Cliq Mobile disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and quiet enjoyment.
Cliq Mobile does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. Cliq Mobile does not warrant any particular outcome regarding Lifeline application approval, coverage in your area, plan pricing, or the continued availability of any third-party provider.
For shop products, except to the extent required by applicable state or federal law, Cliq Mobile provides no warranty separate from the manufacturer's warranty (where any) and disclaims all implied warranties to the maximum extent permitted by law. Some jurisdictions do not permit the disclaimer of implied warranties; in those jurisdictions, the disclaimers in this section apply only to the extent permitted.
15. Limitation of liability
To the fullest extent permitted by applicable law, in no event shall Cliq Mobile, its members, officers, directors, employees, contractors, or agents (the "Cliq Parties") be liable to you or to any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, data, or substitute products or services, arising out of or in connection with these Terms, the Site, the shop, or any content or services accessed through the Site, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.
The aggregate liability of the Cliq Parties to you for all claims arising out of or relating to these Terms or the Site, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the amount you have paid Cliq Mobile for shop purchases in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
The limitations in this section apply regardless of the failure of essential purpose of any limited remedy. Some jurisdictions do not permit the limitation or exclusion of certain damages; in those jurisdictions, the limitations in this section apply only to the extent permitted.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Cliq Parties from and against any claim, action, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms or of any law or regulation; (b) your use of the Site; (c) your Submissions; or (d) your violation of any third-party right (including intellectual-property or privacy rights).
17. Termination
We may suspend or terminate your access to the Site or to any feature of the Site at any time, with or without cause or notice, including for breach of these Terms. Provisions that by their nature should survive termination will survive, including §§ 5 (affiliate relationships), 8 (intellectual property), 14 (warranties), 15 (liability), 16 (indemnification), 18 (disputes), and 19 (governing law).
18. Dispute resolution, arbitration, and class-action waiver
18.1 Informal resolution first
Before initiating any formal dispute, please contact us at [email protected] with a written description of the dispute and the relief you are seeking. We will try in good faith to resolve the dispute informally within thirty (30) days.
18.2 Binding individual arbitration
Except as set out in §18.5, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the relationship between you and Cliq Mobile (each, a "Dispute") shall be resolved exclusively through final and binding individual arbitration rather than in court, and not as a class, collective, representative, or consolidated action.
The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs the interpretation and enforcement of this §18. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules & Procedures, or, if JAMS is unavailable or will not administer the arbitration consistent with this §18, by the American Arbitration Association under its Consumer Arbitration Rules.
18.3 Arbitration procedure
The arbitration will be conducted by a single, neutral arbitrator. Hearings will be held remotely or in Miami-Dade County, Florida, at your election. For claims of $25,000 or less, Cliq Mobile will pay the arbitration administrative and arbitrator fees; the arbitrator may reallocate fees if the arbitrator finds that either side's position was frivolous or brought for an improper purpose. For claims above $25,000, fees are allocated per the applicable arbitration rules.
The arbitrator has exclusive authority to resolve all issues of arbitrability, including whether any particular claim is subject to arbitration, except that a court has authority to decide whether §18.4 (class-action waiver) is enforceable.
18.4 Class-action waiver
You and Cliq Mobile agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, private-attorney-general (PAGA), or consolidated action. The arbitrator may not consolidate claims of more than one person and may not preside over any form of class or representative action. If a court finds the class-action waiver in this §18.4 to be unenforceable with respect to any particular claim, then that claim shall be severed and proceed in court, and the remaining claims shall proceed in arbitration.
18.5 Exceptions
Either party may bring the following in court notwithstanding §§ 18.2 and 18.4: (a) an individual action in a small-claims court for any claim within that court's jurisdictional limits; (b) an action seeking equitable relief (including injunctive relief) in aid of intellectual-property rights or to prevent unauthorized access or use of the Site.
18.6 30-day opt-out right
You may opt out of the arbitration agreement in §§ 18.2–18.4 within thirty (30) days of first accepting these Terms by sending a written notice to [email protected], with the subject line "Arbitration Opt-Out," and including your full name, the email address you have used on the Site, and a statement that you are opting out of the arbitration agreement. If you opt out under this §18.6, the rest of these Terms (including §§ 19 and 20) continue to apply.
18.7 Statute of limitations
Any claim arising out of or relating to these Terms or the Site must be brought within one (1) year after the cause of action accrues, or the shorter period permitted by applicable law, or it will be permanently barred.
19. Governing law and venue
These Terms, and any Dispute not subject to arbitration under §18, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
For Disputes not subject to arbitration and not brought in small-claims court, the exclusive venue is the state or federal courts located in Miami-Dade County, Florida, and each party consents to personal jurisdiction in such courts.
20. General provisions
Entire agreement. These Terms, together with the Privacy Policy, the Affiliate Disclosure, and (for shop customers) the Shipping & Returns policy, constitute the entire agreement between you and Cliq Mobile with respect to the Site and supersede all prior agreements or representations.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be reformed only to the extent necessary to render it enforceable.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any purported assignment without such consent is void. We may assign these Terms freely.
Force majeure. We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, labor disputes, outages of third-party service providers, or governmental action.
Changes to these Terms. We may update these Terms from time to time. Material changes will be posted on this page with a new "Effective date," and, where required by law or for material changes to dispute-resolution terms, we will provide advance notice. Your continued use of the Site after the new Effective date constitutes acceptance of the updated Terms, except that the arbitration opt-out right in §18.6 remains available for thirty (30) days after any update that materially expands the scope of arbitration.
Export control. You represent that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not listed on any U.S. government list of prohibited or restricted parties.
Electronic communications. You consent to receive communications from us electronically, and you agree that any agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
